The lawyers for Goldman Sachs, a global investment banking and securities firm, have been dealing with a lawsuit filed against them by Overstock.com. After Overstock.com filed a motion to disclose certain internal documents of Goldman Sachs, the lawyers for the firm filed an opposition which accidentally made many of their internal documents, such as emails within the company, public record. Among the many issues that were brought to light due to the disclosure of the documents was ?naked short selling.? The speculation throughout Wall Street was that naked short selling was nothing more than a myth, but in fact Goldman Sachs has been participating in this act of high finance counterfeiting for years.

The act of naked short selling is where the investment firm who is hired to purchase stocks (such as Goldman Sachs) does not actually locate or purchase the stocks. By doing so, Goldman Sachs was creating an artificial stock supply. Goldman Sachs was avoiding spending time searching for the stocks and also avoiding paying fees to borrow the stocks. The illegal acts committed by Goldman Sachs have been brought to light only months after the former Goldman Sachs? Executive, Greg Smith resigned and publicly released that the firm took advantage of their clients.

Bobcats part ways with Silas, begin search for new coach

CHARLOTTE, N.C. (AP) -- The worst team in NBA history will have a new coach next season.

The Charlotte Bobcats have decided not to renew coach Paul Silas' contract after the team finished 7-59 this season for the worst winning percentage in league history (.106).

"We have been talking internally about what is best for us going forward," Bobcats president of basketball operations Rod Higgins said at a news conference Monday. "The record kind of speaks for itself. When you look at the youthfulness of this roster ... we just all felt collectively that the change was something we wanted to do at this time."

The 68-year-old Silas, who told The Associated Press late in the season he wanted to "see things through" and coach one more year, said Monday he found out earlier in the day he would not be brought back.

Silas said he was not surprised by the decision.

"I'm ok with that," he said. "I have had a very successful career coaching and playing and it's time to move on."

Silas said he was promised a job in the organization by team owner Michael Jordan and said he's retiring from coaching.

It's unclear who'll replace Silas, who leaves with a 32-88 record at Charlotte. Higgins said a search for his replacement will begin immediately.

"We do not have a timetable. We will start as soon as this presser is over," he said. "I just don't want to say there is a time frame. We plan on interviewing quite a few people. We want to find the right guy."

Higgins said Silas' son, Stephen Silas - who served as an assistant under his father and led the team in several games - will be interviewed for the job, but added finding someone with heading coaching experience "is important."

"We want someone who wants to win," Higgins said. "That's the main quality. We will have quite a few candidates. I would say there are quite a few people who come into mind."

Finding someone who might be interested in taking over the last-place Bobcats might not be easy. They're light on talent and experience and it could be a long way from competing for a playoff spot.

Bobcats general manager Rich Cho is aware this job might not be for everyone.

"Those are the type of coaches we don't want to bring in," Cho said. "I want somebody that will relish the opportunity and look at it as a challenge. It's really easy to go to a winning team and take that opportunity. But I want somebody in here that's going to look at this as a great opportunity and a challenge and a chance to build something from the ground up."

Silas was in a difficult situation heading into the season with a young and inexperienced team, plus a shortened offseason that limited practice time. Injuries to top players like Corey Maggette, D.J. Augustin and Gerald Henderson did not help.

"I respect Paul to the utmost," Higgins said. "He wanted to be successful but it was an unfortunate thing that it didn't happen."

Late in the season, Silas was involved in an altercation with forward Tyrus Thomas, shoving him in the locker room following a loss. The two had gotten into an argument and had to be separated.

But Higgins said that didn't factor into the decision to part ways with Silas.

Players tried to rally to his defense after the season to save his job, but to no avail.

"I think Paul did the best he could with the guys he had on the floor," Maggette said Friday. "We went through a year where night after night guys were going down with injuries and you're shooting under 30 percent from the field. You just can't win any games that way. That's tough. So hopefully they give him an opportunity to show what type of a coach he is and what he can bring to the table here."

But in the end it was hard for the Bobcats to justify keeping him.

They were last in the league in scoring and shooting percentage and lost 22 games by 20 or more points.

Silas said he's unsure what role he'll have with the Bobcats moving forward, but hopes to have some input on personnel decisions.

The Bobcats are guaranteed one of the top four picks in the NBA draft and could have the No. 1 pick overall and a shot at Kentucky's Anthony Davis. They're also expected to be extremely aggressive in free agency, trying to build with some young talent.

"I really know this team and I think I understand this team better than anyone because I've had them for a whole year," Silas said. "So I hope I can be a part of making some decisions as to who we bring in here... All I want to do is see this team be successful. The people in Charlotte deserve it."

Silas entered the season with a career coaching mark of 380-429 and a 13-16 mark in the playoffs in 11 seasons as an NBA coach. He previously coached the San Diego Clippers, Charlotte Hornets, New Orleans Hornets and Cleveland Cavaliers.

As for Silas' assistant coaches, their contracts expire on June 30. No decision has been made as to their future.

White House Petitioned to Make Research Free to Access

More than 17,000 people have signed an online petition urging US President Barack Obama to require all scientific journal articles resulting from US taxpayer-funded research to be made freely available online. The signatures, obtained within a week of the petition's launch after an active social media campaign, put it over two-thirds of the way towards the threshold that will require an official response from the White House.

It comes as the University of California, San Francisco (UCSF) ? one of the largest biomedical institutions in the United States ? becomes the latest institution to require its researchers to make their articles freely available in an open-access repository. However, they can opt out if it brings them into conflict with publishers. The Massachusetts Institute of Technology in Cambridge and various Harvard University schools are among those with similar policies in place.

The petition, on the White House website, was launched by Access2Research, a group of four open-access advocates who were frustrated by the lack of progress on the issue and so are trying a new tack. The petition urges the president to ?act now to implement open access policies for all federal agencies that fund scientific research?.

The National Institutes of Health (NIH) in Bethesda, Maryland, is the only US government agency that requires researchers to deposit their articles in the agency's PubMed Central online archive within 12 months of publication, a policy that followed a bill passed by Congress in 2007. It is estimated that about 90,000 papers are deposited each year, with half a million people accessing the database of 2.4 million papers each day.
Getting the ball rolling

?We know the NIH policy works to provide public access and there have been no data presented that it hurts publishers? revenues, so we are asking for that policy to be extended,? says John Wilbanks, a senior fellow at the Ewing Marion Kauffman Foundation in Kansas City, Missouri, and one of the four people spearheading the petition.

The proposed extension would see open-access polices cover all 12 federal-science agencies, including the Department of Energy, the National Science Foundation, NASA, the Environmental Protection Agency and the Department of Agriculture. The petition does not stipulate a time period within which articles should be deposited or a particular repository, to give agencies flexibility, Wilbanks says.

The agencies together receive about US$60 billion in federal research dollars each year, with about half going to the NIH, so the number of papers available annually could double under the proposal, says Heather Joseph, another petition leader and executive director of the pro-open access Scholarly Publishing and Academic Resources Coalition, based in Washington DC.

Assuming the petition tops 25,000 signatures before 19 June, there must be an official response from the administration. ?It at least puts the issue in front of the president's staff for consideration. The response could be as weak as a simple acknowledgement, or as strong as a policy statement or directive?, such as an executive order telling agencies to expand the NIH policy, Joseph adds.

The timing of the petition is no accident. A bipartisan bill ? the Federal Research Public Access Act (FRPAA) 2012 ? that advocates extending the NIH policy to other federal agencies, and shortening the time frame in which papers must be deposited from 12 months to 6, is making its way through Congress. The White House is also currently reviewing its open-access policies.

?We want the White House to state its position because it could get the ball rolling with agencies, and we want FRPAA because it is much harder to overturn,? says Joseph.

Report: Facebook in talks to buy browser-maker Opera

A new report indicates that Facebook, fresh off its initial public offering, is in talks to acquire Web browser maker Opera Software.

Tech blog Pocket-lint, citing unnamed "trusted sources," reported that the social media giant is looking to buy Oslo, Norway-based Opera to expand into the browser space. In doing so, Facebook would be facing competition from the likes of Google, Microsoft, Mozilla, Apple ? and even Yahoo, which just this week launched its own Axis browser.

A spokeswoman for Facebook declined to comment about the rumor when contacted by PCMag on Friday. Opera also declined to comment.

"As a standard policy Opera does not respond to market rumors and we have no comment to the rumor addressed in the question," the company said in a statement.

However, The Next Web reported that a "source close to Opera" claims the browser maker is currently in the midst of a hiring freeze, and its management is talking to potential buyers. The company's leadership is reportedly considering becoming part of a larger privately held or public company, instead of trying to keep growing the business on its own.

Opera, which makes browsers for desktops, tablets, and smartphones, is currently listed on the Oslo Stock Exchange. The company says that about 270 million people use its browsers every month.

Facebook, meanwhile, last month bought the photo-sharing service Instagram for $1 billion. The social network also recently picked up the developers of the Lightbox Android photo app, along with 750 patents from IBM.

FUKUSHIMA, Japan -- Amid concerns of a new disaster should a quake destroy the pool cooling off radioactive nuclear fuel rods at Fukushima's Reactor No. 4, Japan on Saturday arranged a tour for journalists and declared the situation manageable -- but also very long term.

"I don't think the situation is unstable," said Goshi Hosono, Japan's environment minister and the man in charge of the cleanup. He was speaking to reporters after his first tour of the twisted and partly destroyed building that houses the reactor.

Hosono said he expected workers to begin removing fuel from the reactor's storage pool next year.

Work began last month to raise what amounts to a giant tent over the building to keep radioactive dust from scattering during the transport of the fuel rods, which now are under just a tarp at the top of the building.

Senator Ron Wyden was the first U.S. Senator to get a look inside Japan's Fukushima nuclear energy plant. Wyden discusses what he saw inside the plant and whether or not imported food from Japan is safe to eat.

Hosono said his biggest concern was ensuring Japan could secure the labor and talent to finish the decommissioning of the Fukushima reactors over the coming decades.?

"This may take 30 or even 40 years to complete and extremely difficult work is still ahead of us," he said.

Tokyo Electric Power, the utility that operates the Fukushima Daiichi plant, says its analysis shows the No. 4 reactor building would hold up in a strong earthquake even after being badly damaged by a hydrogen explosion when three nearby reactors suffered meltdowns in March 2011.

Japanese safety regulators on Friday ordered Tepco to recheck its findings after measurements showed the west wall of the reactor building was buckling out by about 1.2 inches.

Some experts believe the fuel in the pool is now too weak to generate much radioactivity, but others are still worried.

"The No. 4 reactor is visibly damaged and in a fragile state, down to the floor that holds the spent fuel pool," Hiroaki Koide, an assistant professor at Kyoto University?s Research Reactor Institute, told the New York Times. "Any radioactive release could be huge and go directly into the environment."?

Hosono said the government accepted Tepco's estimate that the No. 4 reactor could withstand an earthquake measuring a "strong 6" on the Japanese scale.

The magnitude 9 quake last March that triggered a tsunami and overran Fukushima's backup power systems was measured at 7 on the Japanese scale.

Some environmental critics charge the No. 4 reactor presents a particular risk of a knock-on disaster if a subsequent earthquake were to topple it or puncture its fuel storage pool and allow the 65 feet of water now covering and cooling 1,535 uranium fuel assemblies to drain away.

Such an accident, they say, could release far more radiation than the leaks of radioactive water Tepco has battled since improvising a system for cooling reactor cores last year.

Hosono climbed a narrow and dark staircase built with scaffolding to take reporters to the top of the No. 4 building where the fuel pool has been covered with a tarp.

Tepco has taken steps to shore up support for the pool, which measures ?30 feet by 60 feet across, by adding a cement column underneath.

Officials from the utility demonstrated how they were using water in the pool as a kind of level to confirm the building was not tipping. They also showed a grid of floats holding up the tarp they said could support a person if a worker fell in.

Why I Quit the Catholic Church

They say you can?t be neutral on a moving train, and if recent developments on the American political scene have demonstrated anything, it?s that the Catholic Church is a train headed in a pretty distressing direction: away from equality and social justice, and set on a collision course with the wall of separation between church and state.

As if the child abuse scandals from the last several decades and the complicity and cover-ups that seemed to reach to the highest levels of the Church weren?t enough, now there?s the crackdown on American nuns who, in their commitment to social justice and helping the poor, have been accused by U.S. priests and bishops of straying too far from sanctioned Church doctrine and not spending enough time denouncing feminists and gays. It?s also clear that pressure from Catholic religious leaders plays a large role in the Republicans? ?war on women? and some of the recent bills proposed to restrict access to birth control and health care for women, all in the name of religious freedom. For those of us who have been keeping an uneasy eye on the socially conservative, theologically strict and consistently anti-feminist Pope Benedict XVI since his appointment seven years ago, this most recent response of the Catholic Church really comes as no surprise.

And so it?s no real surprise that there?s push-back from atheists, secularists and humanists who?ve about had it with an antiquated, patriarchal hierarchy trying to actively interfere with the democratic processes of government. The anger and disgust is clear in a recent, full-page ad run in the Washington Post by the Freedom From Religion Foundation, asking ?liberal? and ?nominal? Catholics to quit the Church once and for all:

It?s time to quit the Roman Catholic Church. Will it be reproductive freedom, or back to the Dark Ages? Do you choose women and their rights, or Bishops and their wrongs? Whose side are you on? [...] The Church that hasn?t persuaded you to shun contraception now wants to use the force of secular law to deny birth control to non-Catholics. You?re better than your church, so why stay? Why put up with an institution that discriminates against half of humanity?

The language of the FFRF ad is harsh, and in many ways it over-reaches when it turns from criticisms of the Church as an institution to mockery of religious belief in general. In an editorial response, E.J. Dionne writes that he is not planning on quitting the Catholic Church any time soon, and he dismisses many of the ad?s arguments as just the ?usual criticism? that liberal Catholics face, saying:

Catholic liberals get used to these kinds of things. Secularists, who never liked Catholicism in the first place, want us to leave the church, but so do Catholic conservatives who want the church all to themselves.

I?m sorry to inform the FFRF that I am declining its invitation to quit. They may not see the Gospel as a liberating document, but I do, and I can?t ignore the good done in the name of Christ by the sisters, priests, brothers and lay people who have devoted their lives to the poor and the marginalized.

Like the FFRF ad, Dionne makes no distinction between the Church as an institution and Catholicism as a religion, and his commitment to the latter means that he?s a part of the former, come hell, high water, or anti-feminist disciplinary crackdown on the very sisters and lay people whom he credits for inspiring his Catholic faith.

But Dionne?s response weakens when he tries to tackle the most interesting challenge presented in the ad, the belief that liberals, by remaining part of the Catholic Church, can help change the Church from within:

If you think you can change the church from within ? get it to lighten up on birth control, gay rights, marriage equality, embryonic stem-cell research ? you?re deluding yourself. By remaining a ?good Catholic,? you are doing ?bad? to women?s rights. You are an enabler. And it?s got to stop.

With more than a little snark, Dionne calls out the ad for its overuse of unnecessary quotation marks and off-handedly dismisses the accusation of being an enabler almost as if he doesn?t know what enabling looks like (like, say, dismissing criticisms of destructive behavior on superficial grounds such as grammar or tone). Yet for all his disagreement, Dionne doesn?t offer a single practical way in which liberal Catholics can successfully challenge, from within, the extreme conservative direction that today?s Church is heading.

Dionne?s best attempt is to recall the somewhat-feminist leanings of Pope John XXIII, who wrote in a 1963 papal encyclical that ?far from being content with a purely passive role or allowing themselves to be regarded as a kind of instrument, [women] are demanding both in domestic and in public life the rights and duties which belong to them as human persons.? Yet in that same encyclical, Pope John XXIII wrote that while a man ?has the inherent right not only to be given the opportunity to work, but also to be allowed the exercise of personal initiative in the work he does? ? ?women must be accorded such conditions of work as are consistent with their needs and responsibilities as wives and mothers.? Hardly the ringing endorsement of gender equality and self-determination for women that Dionne might lead us to believe.

But even if it were, his attempt to challenge the conservative Church from within consists of little more than ?wishing? that Catholic bishops were more familiar with Pope John XXIII and ?wondering? if the bishops realize how their anti-feminist stance strengthens the Church?s adversaries. Neither of these seem to be very effective or practical ? let alone very compassionate towards women who have more at stake than whether or not Catholicism beats secularism in a popularity contest. Dionne himself acknowledges that these are by no means new criticisms of the Church, but fails to wonder why such criticisms are on-going if the liberal challenge from within were really all that effective. All the more discouraging is that American women religious, who might be the best example of liberal Catholics challenging the Church from within its own ranks, are getting a very real taste of how Church leadership responds when that internal challenge becomes too effective and wide-spread.

In the end, Dionne never actually addresses what is perhaps the most important point of the FFRF ad. Much of the Church?s political power derives from the sheer number of Catholics who count themselves members of the Church even when Church leaders do not really represent their views at all. In fact, representing the views of lay Catholics isn?t even in the job description. The Catholic Church is not, and never has been, a representative democracy.

Politicians looking to score votes and gain support see one massive block of well-financed power consolidated in the hands of a few conservative male leaders who dictate religious doctrine and ethics for millions. They form political alliances and propose religiously conservative legislation with that view of the Church in mind?. and they do so because, for the most part, it works.

One example of why it works is the Manhattan Declaration. Sponsored by conservative Christian leaders back in 2009, it was intended to ?rejuvenate the political alliance of conservative Catholics and evangelicals that dominated the religious debate during the administration of President George W. Bush? and to call President Obama?s attention to the ?formidable force? that this conservative religious alliance has in pushing for anti-women and anti-gay legislation. As of today, the Manhattan Declaration has more 525,000 signatures.

A similar petition proposed by liberal Christians to counter the Manhattan Declaration and to affirm support for equal rights for all, regardless of gender or sexual orientation?. sputtered to a pathetic halt with less than 3,000 signatures.

This is too often what Catholic liberal resistance looks like. Trying to stay neutral on a moving train.

Though my own journey away from the Catholic Church culminated in a definitive break more than eight years ago, when it became known that a close family friend had suffered from on-going sexual abuse as a child at the hands of a trusted Catholic priest, my journey began much earlier than that. My devotion to the ideals of Christ ? peace, social justice, care for the poor and the marginalized, the law of love ? led me in search of a deeper spiritual authenticity that, according to the standards of today?s Catholic Church, had led me far astray from sanctioned Church doctrine long before I ceased to call myself Catholic.

In many ways, the Catholic Church abandoned me years before I finally woke up to the fact and left of my own accord. For years, I struggled with the feeling of being a solitary Catholic liberal crying out in the wilderness. Like Dionne, I felt beleaguered by atheists and secularists on the one side of me, criticizing Catholicism for being a monolithic monstrosity of backwards-looking conservative patriarchy, while on the other side of me were many of my fellow Catholics striving to make the Church exactly that. I braced myself against the notion of being an example of everything that a Catholic could be ? open-minded, intelligent, and feminist while still being devoted to the basic teachings of the Church.

But eventually, the cognitive dissonance and the sense of betrayal were too much to bear. Unlike Dionne, I am a woman ? and for that reason alone, no matter how devoted I remained to the church, I would never be welcomed into the halls of power. The efficacy of my ?challenge from within? was inherently and irrevocably restricted. And though I valued loyalty and honored the traditions of my family deeply, I also came to realize that one of the Catholic Church?s most basic teachings ? the teaching on which the whole damn structure hangs ? is that hierarchy and inequality are divinely sanctioned.

I didn?t leave the Church because I no longer believed in Christ, or the sacred mystery of love, or the importance of religious community, or the valuable insights from Catholic theologians, saints and mystics in the past. I left because I no longer believed in the Church as a just or ethical socio-political institution. As my brilliant stepdaughter recently pointed out, ?You don?t give any one leader a lot of power just because he seems like a good guy, because you never know whether or not the next one who comes along is also going to be good.? We didn?t reject monarchy in favor of democracy because all kings were bad; we rejected it because the political institution of kingship was itself an opportunity for abuse and injustice.

The same theology of hierarchy and patriarchy that buttresses the current institution is also the reason why Dionne is not, despite what he apparently imagines, participating in a democratic and representative religious community in which liberals and conservatives vie for influence. Dionne might appeal to the slightly more liberal views of previous Popes, but the fact is, as a lay Catholic he has no part in the process of choosing who the next infallible leader of his religion will be. The Catholic Church is not an institution steered by consensus. Conservative Catholic leaders are in power: they?re laying the tracks and they?re at the wheel. Liberal Catholics are little more than passengers on this train and they will, as American nuns are now discovering, one day face the angry countenance of the conductor demanding to see their tickets.

This was a difficult piece to write. Many of my closest friends, not to mention family members, are Catholics, and I hold great sympathy for those who have remained members of the Church despite the scandals and abuses over the years. They possess a degree of devotion and loyalty that is admirable.

My hope is that their devotion is not misplaced. That they do not make an idol of the institution. That they have the wisdom to see the difference between Catholicism as a faith, and the Church as a socio-political construct, and that they do not compromise the one for the sake of up-holding the other. My hope is that they follow the example of their sisters and women religious, rather than the examples of their priests and bishops. And to be honest, I hope that, in doing so, they will dismantle and remake the Church as we know it.

Because if they don?t, the Catholic Church will die, because it deserves to die. And a great tradition will be lost.

When they got back together, she negotiated some terms of the relationship: He had to spend 100 minutes of private time with her per week, they had to take vacations out of the country for two weeks at a time each year, and he had to consider getting married to her.
  • Zuckerberg was hesitant about getting married because he thought it would hurt Facebook's youthful image, says the NYT.

Organized Crime Exploits China?s Growing Links to Latin America

In April 2012, authorities in the prosperous and generally peaceful Caribbean nation of Belize intercepted a shipment of precursor chemicals sent from China and apparently bound for representatives of the Mexican cartel ?Los Zetas.?? The shipment?sufficient to produce an estimated $10 billion in methamphetamines?highlights growing criminal ties between China and Latin America that have accompanied, but, to date, have lagged behind the exponential growth of trade and investment between the two regions (7 Belize News, April 11).

The limited amount of publicly available evidence suggests that criminal activity spanning the two regions is concentrated in five current or emerging domains: (1) extortion of Chinese communities in Latin America by groups with ties to China; (2) trafficking in persons from China, through Latin America, to ultimately smuggle Chinese into the United States or Canada; (3) trafficking in narcotics and precursor chemicals; (4) trafficking in contraband goods; and (5) money laundering.

Calls for President Jacob Zuma to fire suspended police commissioner Bheki Cele are increasing. A leaked report indicates that a board of inquiry found that Cele was not fit to hold the office and should be removed.
The inquiry dealt with allegations of misconduct relating to two leases for new police headquarters in Pretoria and Durban, which Cele signed with businessman Roux Shabangu.
President spokesperson Mac Maharaj says President Zuma is busy studying the report.

Invasive species underwater: Deep sea animals stowaway on submarines and reach new territory

ScienceDaily (May 24, 2012) ? Marine scientists studying life around deep-sea vents have discovered that some hardy species can survive the extreme change in pressure that occurs when a research submersible rises to the surface. The team's findings, published in Conservation Biology, reveal how a species can be inadvertently carried by submersibles to new areas, with potentially damaging effects on marine ecosystems.

After using the manned submersible Alvin to collect samples of species from the Juan de Fuca Ridge under the northeastern Pacific Ocean, the team discovered 38 deep-sea limpets (Lepetodrilus gordensis) among their sample. Intriguingly this species is believed to occur only in the vents of the Gorda Ridge, which are 635 km south of the dive site.

"The big question was, how did they get over 600 kilometers from their habitat?" said Dr. Janet Voight, from the Field Museum of Natural History in Chicago. "We discovered that the individuals must have been transported from the Gorda Ridge by our submersible. Even though we clean the submersibles after sampling we had assumed that the extreme pressure change would kill any species which are missed."

The introduction of new species to an ecosystem by humans, often inadvertently, is a big challenge to conservation. How a new species will react to new surroundings, and the effect it can have, is unpredictable. Increases in deep-sea drilling and submersible activity can increase the probability of introductions, but until now hydrothermal vents have been considered too extreme and too isolated to be a source of introduced species.

In coastal environments one of the biggest threats posed by invasive species to native species is disease, as newly introduced pathogens and parasites can cause mass mortality. Diseases that may exist in the extreme environments created by hydrothermal vents have not been well studied.

"We've discovered that it is possible to accidently introduce a species, and any potential diseases it may carry, from a deep-sea vent to a new location," concluded Voight. "This has implications for the future exploration of hydrothermal vents as it reveals the potential risk of human driven change to the ecosystem."
